Terms of Use

1. Purpose and acceptance

These Terms of Use (hereinafter the "Terms") govern access to and use of the TeeConnect mobile application and its associated services (hereinafter "the Service"), published by TeeConnect, a company incorporated under Belgian law.

By creating an account or using the Service, you accept these Terms without reservation. If you do not accept these Terms, you must not use the Service.

These Terms are governed by Belgian law and by European Union law, in particular Regulation (EU) 2016/679 (GDPR) and Regulation (EU) 2022/2065 on a Single Market for Digital Services (DSA).

2. Description of the service

TeeConnect is a mobile application that connects golfers with one another. The Service allows you in particular to:

  • Create a golfer profile with your handicap, location and business sector
  • Search for and meet other golfers based on affinities (matching)
  • Organise and join golf rounds
  • Communicate through a built-in messaging system
  • Discover golf clubs and partner offers

The Service is free in its basic version. Premium features may be offered at a later stage.

3. Registration and account

3.1. Registration requirements

To use the Service, you must:

  • Be aged 16 or over
  • Provide accurate and up-to-date information when registering
  • Have a valid email address

3.2. How to register

Registration is possible via:

  • Creating an account with an email address and password
  • Signing in with Google OAuth
  • Signing in with Apple Sign-In

3.3. Account security

You are responsible for keeping your login credentials confidential and for all activity carried out from your account. You undertake to notify us immediately of any unauthorised use of your account at contact@teeconnect.io.

3.4. One account per person

Each user may hold only one account. Creating multiple accounts is prohibited and may result in the suspension of all the accounts concerned.

4. User obligations

4.1. Conduct

By using the Service, you undertake to:

  • Respect other users and behave courteously
  • Provide truthful information on your profile
  • Refrain from using the Service for purposes contrary to the law or to public morality
  • Refrain from harassing, threatening or intimidating other users
  • Refrain from impersonating a third party

4.2. Prohibited content

It is strictly prohibited to publish, transmit or share through the Service:

  • Any unlawful, defamatory, abusive, discriminatory or hateful content
  • Any pornographic or sexually explicit content
  • Any content glorifying violence or terrorism
  • Any content infringing the intellectual property rights of third parties
  • Any spam, unsolicited advertising or unauthorised commercial content
  • Any malware, virus or destructive code
  • Any personal data of third parties without their consent

4.3. Technical use

It is prohibited to:

  • Attempt to access systems or data without authorisation
  • Use bots, scrapers or automated tools to access the Service
  • Disassemble, decompile or reverse engineer the Service
  • Intentionally overload the Service's infrastructure

5. Intellectual property

5.1. TeeConnect's rights

The TeeConnect application, its source code, design, texts, logos, trade marks and any other element making up the Service are the exclusive property of TeeConnect and are protected by Belgian, European and international intellectual property law.

Any unauthorised reproduction, representation, modification or exploitation, in whole or in part, is strictly prohibited.

5.2. User content

You retain ownership of your content (photos, messages, profile information). By posting it on the Service, you grant TeeConnect a non-exclusive, worldwide, royalty-free and transferable licence, for the duration of your use of the Service, for the purposes of:

  • Displaying your content to other users of the Service
  • Ensuring the technical operation of the Service (storage, caching, resizing)

This licence ends within 30 days after your content or your account is deleted.

6. Liability

6.1. TeeConnect's liability

TeeConnect endeavours to ensure the availability and proper operation of the Service. However, the Service is provided "as is" and TeeConnect does not warrant:

  • Uninterrupted availability of the Service
  • The absence of errors or malfunctions
  • The accuracy of the information provided by other users
  • The quality of the meetings or golf rounds arranged through the Service

TeeConnect may not be held liable for indirect damage, including but not limited to loss of data, loss of opportunity or non-material damage, arising from the use of or the inability to use the Service.

6.2. User liability

Each user is solely responsible for their use of the Service, for their interactions with other users and for the content they post. TeeConnect acts as a hosting service provider within the meaning of the DSA and is not liable for content posted by users, subject to its obligation to remove content following a notice in accordance with Article 16 of the DSA.

7. Moderation and sanctions

7.1. Reporting

Any user may report content or behaviour that breaches these Terms using the reporting features built into the application or by email to contact@teeconnect.io.

In accordance with the DSA (Art. 16), we will acknowledge receipt of your notice and inform you of the action taken as soon as possible.

7.2. Measures

In the event of a breach of these Terms, TeeConnect reserves the right to take the following measures, in a proportionate manner:

  • A warning sent to the user
  • Removal of the content at issue
  • Temporary suspension of the account
  • Permanent deletion of the account

In accordance with the DSA (Art. 17), the user will be informed of the decision taken, the reasons for it and the redress available.

7.3. Redress

The user has the right to contest a decision. Any complaint may be sent by email to contact@teeconnect.io within 30 days of notification of the decision. TeeConnect undertakes to examine the complaint within a reasonable time.

8. Termination

8.1. By the user

You may delete your account at any time from the application settings. Deletion results in the erasure of your personal data in accordance with our Privacy Policy.

8.2. By TeeConnect

TeeConnect may terminate your account in the event of a breach of these Terms, after informing you and giving you the opportunity to respond, except in the case of a serious breach requiring immediate action.

9. Governing law and jurisdiction

These Terms are governed by Belgian law.

In the event of a dispute concerning the interpretation or the performance of these Terms, the parties will endeavour to reach an amicable solution. Failing this, the dispute will be submitted to the competent courts of Brussels (Belgium).

If you are a consumer, you may also submit the dispute free of charge to an alternative dispute resolution (ADR) body. In Belgium, the entry point is the Consumer Mediation Service: consumerombudsman.be.

10. Changes to the Terms

TeeConnect reserves the right to amend these Terms at any time. In the event of a substantial change, we will inform you by in-app notification or by email at least 30 days before the new terms take effect.

Continuing to use the Service after the changes take effect constitutes acceptance of the new Terms. If you do not accept the changes, you may delete your account.

11. Miscellaneous provisions

  • Entire agreement: these Terms constitute the entire agreement between you and TeeConnect regarding the use of the Service.
  • Severability: if any provision of these Terms is held to be void or unenforceable, the remaining provisions will remain in force.
  • Waiver: TeeConnect's failure to exercise a right provided for in these Terms does not constitute a waiver of that right.
